Welcome to Nuco Home. This website, www.nucohome.com, is operated by Nuco Home Limited, registered in England and Wales under company number 14366441. Our registered address is Unit 15 Carrock Road, Croft Business Park, Bromborough, Wirral, CH62 3RA. Our VAT registration number is 463523690. References to "we", "us" or "Nuco Home" mean Nuco Home Limited.

Our store is powered by Shopify, which enables us to provide our website, content, features, products and services to you (together, the "Services").

These Terms of Service, together with our Privacy Policy and Delivery & Returns policy, describe your rights and responsibilities when you use the Services. Please read them carefully. By using our website or placing an order, you agree to these Terms. Nothing in these Terms affects your legal rights as a consumer.

 

2. Using Our Website and Your Account

You must be at least 18 years old to place an order with us. You agree to use our website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the site.

If you create an account, you are responsible for keeping your login details secure and for all activity on your account. Please make sure the information you give us, including your email, billing and delivery details, is accurate and up to date so we can fulfil your order and contact you if needed. Accounts may not be transferred or sold to anyone else.

We reserve the right to withdraw, modify or suspend access to the website, or to suspend or close accounts that breach these Terms, at any time.

 

3. Our Products

We make every effort to display our products accurately, including colours and dimensions. However, colours may appear slightly different depending on your screen and device settings, and dimensions are approximate. Product images are for illustrative purposes, and styling accessories shown in lifestyle images are not included unless explicitly stated.

Product descriptions may be updated from time to time, and we reserve the right to discontinue any product or limit quantities available. None of this affects your rights in relation to products you have already purchased, which must match their description and be of satisfactory quality and fit for purpose, as required by the Consumer Rights Act 2015.

Purchases from our website are for personal and household use, not for commercial resale.

 

4. Placing an Order

When you place an order, you are making an offer to purchase the product(s) at the price shown. An order confirmation email does not constitute acceptance of your offer. Acceptance occurs when we dispatch your order and send you a dispatch confirmation, at which point a contract is formed between you and Nuco Home Limited.

We reserve the right to refuse or cancel any order before dispatch, for example if a product is out of stock, a pricing error has occurred, or we suspect fraudulent activity. If this affects your order, we will contact you using the details you provided and refund any payment taken.

 

5. Prices and Payment

All prices are shown in pounds sterling and include VAT at the applicable rate. Delivery charges are shown separately at checkout and on our Delivery & Returns page. A VAT receipt is available on request, please contact info@nucohome.com with your order number.

Prices, discounts and promotions may change at any time, but the price you pay is the price displayed at the time you place your order, as confirmed in your order confirmation email. We reserve the right to correct any obvious pricing errors before dispatch, and if an error affects your order we will contact you before proceeding. Promotions may be subject to their own separate terms, which will apply to that promotion.

We accept payment by debit and credit card via Shopify Payments, Shop Pay and Apple Pay. All payments are processed securely by PCI DSS compliant payment providers and we do not store your full card details. Buy Now Pay Later services such as Klarna and Clearpay are provided by third parties under their own terms, which you should review before using them. Payment must be received and processed before your order is dispatched.

 

6. Delivery

Delivery options, timescales and charges are set out in full on our Delivery & Returns page. We will make every reasonable effort to deliver within the estimated timeframe, but delivery dates are estimates and not guaranteed. We are not liable for delays caused by our courier partners or events outside our reasonable control, though where a delay occurs we will keep you informed and you may contact us to cancel and receive a refund if the delay is substantial.

The products are your responsibility from the time they are delivered to the address you gave us. Ownership of the products passes to you on delivery or once we have received full payment, whichever is later.

 

7. Your Right to Cancel

If you change your mind, you have a legal right under the Consumer Contracts Regulations 2013 to cancel your order within 14 days of receiving your goods, without giving a reason, and a further 14 days to return them to us.

Our own returns policy goes further than this. We offer 60 days from delivery to return your order, as set out on our Delivery & Returns page, which also explains how to request a return through your account. Your statutory rights are not affected by our policy, and where our policy is more generous, you are welcome to rely on it.

Return postage for unwanted items is paid by you, and items should be returned unused, securely packaged and in their original protective packaging. For full details, please refer to our returns policy.

 

8. Faulty or Damaged Items

Under the Consumer Rights Act 2015, our products must be of satisfactory quality, fit for purpose and as described. If something arrives faulty or damaged, you have a legal right to a full refund within 30 days of delivery, or to a repair or replacement after that. Our Delivery & Returns page explains how to report a damaged or faulty item, and we will always cover the cost of returning faulty goods.

 

9. Intellectual Property

All content on this website, including product images, text, logos, graphics, designs, video and audio, and the arrangement of them, is owned by Nuco Home Limited or its licensors and is protected by United Kingdom and international copyright, trade mark and other intellectual property laws.

You may use the Services for your personal use only. You must not reproduce, distribute, modify, republish or commercially exploit any of our content without our prior written consent. Nuco Home's name and logo are our trade marks and may not be used without permission. Shopify's name, logo and product names are trademarks of Shopify. All other trademarks remain the property of their respective owners.

 

10. Reviews and Feedback

We love hearing from you. If you submit reviews, photos, suggestions or other content to us or about our products ("Feedback"), you grant us a worldwide, royalty free licence to use, reproduce and display that Feedback for any purpose, including promoting our products and improving our Services.

You confirm that any Feedback is your own honest opinion and your own work, that it does not infringe anyone else's rights, and that you have disclosed any incentive or compensation received in connection with it. Please keep Feedback lawful and respectful. We may remove content that is unlawful, offensive, misleading or infringes these Terms, and we are not obliged to publish, respond to or compensate you for Feedback.

 

11. Third Party Links and Tools

Our website may contain links to third party websites or make third party tools available, such as payment providers or social media features. We don't control third party sites or tools and are not responsible for their content, accuracy or practices. If you use them, you do so at your own discretion and subject to the relevant third party's own terms, which we'd encourage you to read.

 

12. Relationship with Shopify

Nuco Home is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Nuco Home. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Nuco Home, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Nuco Home.

 

13. Privacy

All personal information we collect through the Services is handled in accordance with our Privacy Policy. Because our store is hosted by Shopify, Shopify also collects and processes certain information about your use of the Services in order to provide and improve them, and information you submit may be shared with Shopify and our service providers, some of whom may be located outside the UK. Our Privacy Policy explains how we, Shopify and our partners use your personal information.

 

14. Acceptable Use

You may use the Services for lawful purposes only. You must not use the Services to break the law, infringe intellectual property rights, harass or harm others, transmit false or misleading information, send spam, impersonate any person, upload viruses or malicious code, scrape or harvest data, interfere with the security or operation of the website, or copy, resell or exploit any part of the Services. We reserve the right to suspend or terminate access for anyone breaching these Terms.

 

15. Our Liability to You

If we breach these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach, but we are not responsible for losses that are not foreseeable, or for business losses, as we supply products for personal and household use only.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights under the Consumer Rights Act 2015, or for any other liability that cannot be excluded or limited under the law of England and Wales.

 

16. Events Outside Our Control

We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, such as severe weather, strikes, courier failures, or supply disruption. If such an event affects your order, we will contact you as soon as possible, and if the delay is substantial you may cancel your order for a full refund.

 

17. Complaints and Disputes

We are committed to resolving any issue fairly and promptly. If you have a complaint, please contact us first at info@nucohome.com and we will do our best to put things right. If you are not satisfied with our response, you may be able to refer the matter to an alternative dispute resolution provider, and you can contact us for further information. Nothing in this section affects your right to bring a claim in court.

 

18. Other Important Terms

If any part of these Terms is found to be unlawful or unenforceable, the rest of the Terms will continue to apply. If we don't enforce a right under these Terms straight away, we can still enforce it later. You may not transfer your rights under these Terms to anyone else without our written consent. We may transfer our rights and obligations to another organisation, and we will always tell you if this happens. These Terms, together with the policies they reference, form the entire agreement between you and us regarding your use of the Services.

 

19. Governing Law

These Terms are governed by the laws of England and Wales. You can bring legal proceedings in the courts of England and Wales, and if you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.

We may update these Terms from time to time, and the current version will always be available on this page. We will notify you of any material changes as required by law, and changes will take effect on the date stated. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
